On December 19, 2003, Governor Mitt Romney signed Executive Order 455 (03-13) mandating comprehensive new rules of conduct for all Massachusetts Notaries. Notaries commissioned before December 19 have 90 days - with a deadline of April 19, 2004 - to comply with all of these new rules. Notaries commissioned after December 19 must comply with all of the new rules immediately. See Romney Establishes New Standards for Notaries Public.
Every notarization you perform will be affected. Among the numerous new requirements for Notaries:
- Keep a record of all notarizations in a permanently bound book or "journal".
- Apply new definitions of "satisfactory evidence of identity" and "personal knowledge of identity" in screening signers.
- Use new certificate wording in notarizing all acknowledgements, jurats, signature witnessings and certified copies.
- Use a seal of office containing stipulated components, including a facsimile of the Great Seal of Massachusetts.
With these changes in mind, if you are a notary public in Massachusetts, be sure to check your new guidelines before notarizing a document. If you are a client needing a notary, be sure to have your document prepared with the new changes included in the section that needs to be notarized.
